General Terms and Conditions visitors Keune Family Manifest

1. General

Keune Haircosmetics B.V. (“We” or “Keune”) will organize an exclusive three-day event in Dubrovnik, Croatia named Keune Family Manifest which will take place from Saturday (evening) September 14th 2024 until Monday (noon) September 16th 2024. This event consists of various activities and festivities and will hereinafter be referred to as “Event”. Keune will organize this Event jointly with an external travel agency.

More specific information with regard to the Event will be made available online in 2024. It is important to check the webpage regularly, as we may share important information through this channel from time to time.

These general terms and conditions (“Terms and Conditions”) apply to every legal relationship between Keune and each visitor (“You” or “Guest”) with regard to the booking and attending the Event. By making a booking or by visiting the Event, each Guest accepts these Terms and Conditions.

Keune is at all times entitled to amend or supplement these Terms and Conditions. Please check our specific webpage regularly for the most recent version of the Terms and Conditions.

2. Booking

If you wish to attend the Event, you can make your booking by filling in the online booking form. In the booking, you specify the number of Guests and provide us with the details of all Guests. When booking, you must pay a 10% non-refundable prepayment for each Guest. After we have received and processed your booking, you will receive a confirmation e-mail. Your booking will only be completed once you have paid the 10% non-refundable prepayment.

Please note that our Event is only open to Guests aged 18+ who are registered through your booking. You may replace registered Guests with other persons, provided that you notify us prior to the Event.

3. Costs and payment

The cost of the Event is €1.490 (excluding VAT) for each Guest (“Event Cost”). This amount includes the following:

  • 2x nights hotel stay (based on room occupancy by 2 persons);

  • meals and drinks foreseen in the program from Saturday evening 14 September until Monday morning 16 September;

  • fun program with seminars/excursion/show/party; and

  • transport to and from airport on 14 and 16 September + transport to and from the city on 15 September.

The following costs are not included and are therefore at your own expense:

  • flight (or alternative transport) from your residence to Dubrovnik and back again;

  • travel and/or cancellation insurance; and all other expenses not specified as included.

Upon your booking, 10% of the Event Cost for each Guest must be paid immediately. 70% of the remaining part must be paid before 1st of May 2024. The remaining 20% must be paid before 1st of June 2024. Payments must be made in euro’s.

4. Cancellation

In the unlikely event there are not enough bookings, Keune may cancel the Event. In that case, we will inform you immediately. The costs already paid by you to Keune will be refunded (including the 10% prepayment) in case of cancellation of the Event by Keune. If Keune has to cancel the event due to force majeure, the provisions in paragraph 9 of these Terms and Conditions will apply.

Until June 1st 2024, you may cancel your booking. However, the 10% prepayment will not be refunded and you will be charged an additional 20% cancellation fee on the total Event Costs for each Guest your booking is cancelled. If you cancel after June 1st 2024, the cancellation fee contains the full Event Costs. If you wish to cancel, you must do so by sending a written statement to your Business Developer at Keune.

5. Event

The program of the Event will be announced online. We may make changes to the program. During the Event, photographs, video and sound recordings (‘Materials’) will be made of the Event, festivities and Guests. These images and recordings may be used for promotional purposes by Keune and Keune’s partners. By entering the Event, each Guest unconditionally and irrevocably consents to the processing, publication, reproduction and/or use of the Materials in the broadest sense and without any limitation as regards medium or country. Persons who appear in any Materials are not entitled to any compensation. Each Guest waives its moral rights to the extent permitted by law.

We kindly request you to observe the house rules of the location where the Event takes place. Any consequences of not doing so are at your own risk.

6. Hotel

We have selected a number of hotels where all guests will be accommodated, based on double rooms and occupancy of two persons. Prior to the Event, we will ask for your preferred room arrangements. Single rooms are available on request at extra cost. Please note that Keune determines which guests will be accommodated in which hotel. You may indicate your preference, but unfortunately we cannot always take your preference into account.

7. Insurance

We strongly recommend to take out travel insurance for you and your Guests to cover unexpected costs, such as costs of urgent or unexpected medical treatment, repatriation in the event of accidents or illness, luggage insurance etc.

In addition, you may consider taking out cancellation insurance for you and your Guests, should anyone be unable to participate in the Event due to unexpected circumstances.

8. Liability

Keune can only accept liability for damages to the extent this is the direct result of an attributable shortcoming on the part of Keune. The total liability of Keune is always limited to the compensation of the reasonable, demonstrable and direct out-of-pocket damage and costs of the Guest and will be limited to the amount covered by Keune’s liability insurance.

Any liability of Keune for indirect damage, including but not limited to consequential loss, immaterial damage, loss of profits, lost savings and/or business interruption is expressly excluded.

Damages must be reported to Keune within 48 hours after the Event.

9. Force Majeure

Although of course we hope that it will not be the case, there may be unforeseen circumstances (such as COVID-19 restrictions, governmental measures, strikes, illness, extreme weather conditions, natural disasters, threat of terrorism etc.) that force us to cancel, move to another date or to change the Event. It may also be the case that we decide so in case a substantial number of guests is not able to attend the Event due to travel restrictions.

In that case, Keune will be released of its obligations towards each Guest. However, in case the Event must be cancelled we will use our best endeavours to refund the price paid by you. Should this occur, please check our website for further information.

10. Travel documents

Please note that you and your Guests are responsible for valid travel documents and any necessary visas. In case additional entry conditions apply (for example in relation to Covid), it is also the responsibility of you and your Guests to comply with these conditions.

11. Personal data

For each booking, we need the name of the salon, the name of all participants, e-mail address. This allows us to book your hotel and any activities you participate in. We also give your details others when necessary for a booking, for example to our travel agency and the hotel.

We (or our travel agency or your hotel) may be required (by government authorities) to provide and process your personal data for security and other purposes deemed appropriate. Even if providing data is not mandatory, we may still decide to assist government authorities. If you book for others than yourself, you are responsible for ensuring that those others have agreed to provide their details to Keune for the purposes set out in this paragraph.

Keune (or any partner of Keune) may send you push messages or e-mails to keep you informed on any matter concerning the Event. To the extent required, you explicitly consent to this.

13. Governing law and jurisdiction

The Terms and Conditions are governed by Dutch law. Any dispute that may arise will be submitted to the competent court of Midden-Nederland, location Utrecht, the Netherlands.
